Transfer Process
On receiving the signed sale agreement, the Attorney writes to both parties introducing themselves and requesting their marriage certificates, ANC and ID documents. We can assist and save time in getting these copies and sending them to the attorneys when we instruct them to proceed with the transfer.
Attorney writes to the existing Bondholder, bank or homeowner, requesting the original Title Deed. N.B: If the original Title Deeds has been misplaced etc, the Attorneys has to request a copy from the Deeds office and this process takes at least two weeks.
On receipt of ID documents etc, the original Title Deeds, as well as the official bond documents, Attorney can only now draw up the necessary transfer documents.
Bond Attorneys are appointed by the concerned banks regarding both / and or bond cancellation and bond registration. These Attorneys can only draw up their documents once they receive a ‘fly sheet’ from the Transferring Attorney.
Cancellation of existing bond requires guarantees and a cancellation certificate.
Similarly as for bond registering, attorneys require certain guarantees etc.
Once all guarantees are in place, Seller and Purchaser are notified to sign the relevant documents, and the costs are to be paid.
Electrical and entomologists inspection are done and the necessary reports/certificates requested.
Attorney writes to the local Municipalities for outstanding rates, taxes and water.
Rates are paid from July – June (a year) and a rate clearance certificate has to be issued before lodging.
Similarly as for UGU, a water clearance certificate is required before lodging. (KZN only)
A Transfer Duty Receipt has to be issued before lodging from the Receiver. If money is coming from a Sale of a house, the Attorney is unable to get Transfer Duty Receipt until the first house has been registered and monies become available (unless the Purchaser has additional funds).
Once Bond Attorney and Transferring Attorneys have everything ready and signed, the documents are lodged in the Deeds Office. It takes approximately 7 working days before registration takes place. There is always a chance the Deeds Office rejects something, and whatever it is must be amended so the documents can be re-lodged.
All in all this process takes approx. 12 weeks, sometimes 6 weeks and sometimes months!
